On Saturday, May 9, 2025, Ahmed Mostafa Mohamed Sayed, known as “Zizo,” a first-team player for Zamalek SC, underwent an investigation and hearing regarding his appeal against the disciplinary sanctions imposed by the club’s board of directors, in accordance with the regulations. The sanctions were imposed on the player due to his absence from training and matches for nearly a month, in addition to other violations committed by the player. “Zizo” had been absent from group training for 25 days, beginning April 9, 2025, before returning to training on Sunday, May 4, 2025.
It is worth noting that Zamalek SC has referred Ahmed Mostafa Zizo for investigation more than once, due to what it described as “anti-club statements in the media,” in addition to his absence from training. However, the player refused to attend the investigation sessions on three previous occasions, then suddenly reappeared at training after an absence of nearly three weeks.
On his personal Facebook account, lawyer Ashraf Abdel Aziz posted a photo of himself and the player at the club’s headquarters. The photo was taken during the player’s attendance at an investigation session held by the Zamalek Board of Directors, after he was summoned to testify regarding his appeal against the club’s recent sanctions.
Ashraf Abdel Aziz, the lawyer for Zamalek player Ahmed Mostafa (Zizo), confirmed that his client will not be subjected to any additional investigation sessions within the club. He explained that Saturday’s session was the only one and was attended by a member of the legal committee, without any board officials. Abdel Aziz indicated in press statements that Zizo explained during the investigation the reasons for his absence from team training, in addition to his recent trip to the US embassy. He also revealed that the club has yet to issue an official response to the appeal filed by the player against the sanctions imposed against him.
It appears that Zamalek saw this as an opportunity to prove the player’s and his club’s claims that they feared for his life were false, following an incident in which a club employee tore up his photo and trampled on it after news leaked that he had signed a contract to join Al Ahly and would play for the club after his contract with his current club expired. The club’s official spokesperson commented on the matter, saying:
– Zizo’s presence with his lawyer for the investigations confirms the existence of security and safety in Egypt, not just at Zamalek.
– What Zamalek is doing with Zizo is a model of professionalism and respect, and only what is right is right.
– Things are proceeding legally, and after the legal department completes its work, it will submit a report and recommendations to the board of directors.
To the best of our knowledge, this may be the first time a player or coach has insisted on having their lawyer present during an investigation by their club. It would be no exaggeration to say that sports law has never before addressed this issue with research and substantiation. Therefore, I deemed it appropriate to shed light on this topic, within the framework of a general vision and a general approach aimed at establishing a comprehensive framework for sports law from both the substantive and procedural perspectives. To enrich the topic and foster a sense of serious community engagement on issues of concern to society, I shared a photo of player Ahmed Sayed Zizo with his lawyer on my Facebook page, asking friends and followers interested in sports law to express their opinions on the matter. The comments and opinions were as follows:
– The defendant has the right to be accompanied by his lawyer, regardless of the nature of the violation. There is no specificity in this regard for sports violations. However, in my opinion, the player has taken contradictory positions that may weaken his position. He has stopped training while simultaneously posting photos of himself training in the sand. He justified his absence from training—in a letter from his lawyer—by citing a feeling of insecurity when attending the Zamalek Club. He then posted a selfie with his lawyer, both smiling in the club’s golf cart. How does a lawyer manage a player’s case and his legal dispute? In addition, if visa violations are later proven, the US Embassy will reject the application, and it is likely they will be rejected if the Cup is resorted to. This will undoubtedly have a negative impact on the player (Professor Dr. Abdel Moneim Zamzam, former Dean of the Faculty of Law at Cairo University and Professor of International Private Law at the Faculty).
– This is a fundamental principle in trials, whether criminal or disciplinary (Counselor Ayman Abdel Rahman, Vice President of the State Lawsuits Authority and former Legal Advisor to the Egyptian Olympic Committee).
– One of the rights of the defendant in a disciplinary charge is the right to defense (Counselor Dr. Ahmed Khalaf, Vice President of the Court of Appeal and holder of a PhD in Criminal Law).
– This is an important guarantee in disciplinary trials: the presence of a lawyer with their client during investigations (Ms. Manan Mohamed Yasser, Attorney at the Supreme Court of Appeal).
By reviewing the 2023 FIFA Disciplinary Law or Regulations, specifically Article 39, which appears under the heading “Representation,” we find that it states:
“1 – During any dealings with the Ethics Committee, parties and other persons subject to this Code may seek legal representation at their own expense.
2 – Parties and other persons subject to this Code have the right to freely choose their representatives.
3 – The Ethics Committee may require that representatives of parties and other persons subject to this Code be duly authorized by a duly signed power of attorney.
4 – The Ethics Committee may limit the number of legal representatives if it deems the number excessive.”
Upon entering the Egyptian Football Association’s website, we did not find the Disciplinary and Ethics Regulations issued by the Egyptian Football Association. However, we came across a copy of the regulations dating back to 2019, published on a personal page on the social networking site “Facebook”. We refer through it to the relevant article, Article Fourteen, which appears under the title “Appearance before the Committee.” According to the first clause of this article, “The perpetrator of the violation may seek the assistance of whomever he deems appropriate to legally represent him before the Committee or bring a representative on his behalf unless the Committee requests his personal presence. The Committee may impose the appropriate penalty – in case of necessity – without his presence.”
فى يوم السبت الموافق التاسع من شهر مايو 2025، خضع أحمد مصطفى محمد سيد، الشهير بـ«زيزو»، لاعب الفريق الأول لكرة القدم بنادى الزمالك، إلى جلسة تحقيق واستماع بشأن التظلم المُقدَّم منه على العقوبات الانضباطية التى وقّعها مجلس إدارة النادى عليه، وفقاً للائحة. وجاءت العقوبات ضد اللاعب بسبب انقطاعه عن التدريبات والمباريات ما يقرب من شهر، بجانب المخالفات الأخرى التى قام بها اللاعب. وكان «زيزو» قد انقطع عن التدريبات الجماعية، بداية من يوم 9 أبريل 2025، ولمدة 25 يوماً، قبل أن يعود إلى التدريبات يوم الأحد الموافق الرابع من شهر مايو 2025.
جدير بالذكر فى هذا الصدد أن نادى الزمالك أحال اللاعب أحمد مصطفى زيزو إلى التحقيق أكثر من مرة، بسبب ما وصفه بـ«التصريحات المناهضة للنادى عبر وسائل الإعلام»، بالإضافة إلى تغيّبه عن التدريبات. لكن اللاعب رفض حضور جلسات التحقيق فى ثلاث مرات سابقة، ثم ظهر بشكل مفاجئ للانتظام فى التدريبات بعد غياب لمدة تقترب من ثلاثة أسابيع.
وعبر حسابه الشخصى على موقع التواصل الاجتماعى «فيس بوك»، نشر المحامى أشرف عبدالعزيز، صورة تجمعه باللاعب، أثناء وجودهما داخل مقر النادى. وجاءت الصورة خلال حضور اللاعب جلسة التحقيق التى عقدها مجلس إدارة الزمالك، بعدما تم استدعاؤه للاستماع إلى أقواله بخصوص التظلم المُقدَّم منه ضد العقوبات التى وقّعها عليه النادى مؤخراً.
وأكد أشرف عبدالعزيز، المحامى الخاص بأحمد مصطفى (زيزو) لاعب الزمالك، أن موكله لن يخضع لأى جلسات تحقيق إضافية داخل النادى، موضحاً أن جلسة يوم السبت كانت الوحيدة، وجرت بحضور أحد أعضاء اللجنة القانونية دون وجود أى مسئولين من مجلس الإدارة. وأشار «عبدالعزيز»، فى تصريحات صحفية، إلى أن «زيزو» قد أوضح خلال التحقيق أسباب غيابه عن تدريبات الفريق، بالإضافة إلى شرحه أسباب توجّهه إلى السفارة الأمريكية مؤخراً. كما كشف أن النادى لم يصدر حتى الآن رداً رسمياً على التظلم الذى تقدّم به اللاعب، اعتراضاً على العقوبات الموقّعة بحقه.
ويبدو أن نادى الزمالك وجدها فرصة لإثبات عدم صحة مزاعم اللاعب وناديه بالخشية على حياته بعد واقعة قيام أحد العاملين فى النادى بتمزيق صورته والدهس عليها بعد تسرّب أنباء توقيعه على عقود الانضمام للنادى الأهلى وانتقاله إلى اللعب له بعد انتهاء عقده مع ناديه الحالى. إذ علق المتحدث الرسمى للنادى على الموضوع، قائلاً:
– حضور زيزو مع محاميه للتحقيقات تأكيد لوجود أمن وأمان فى مصر، وليس نادى الزمالك فقط.
– ما يقوم به الزمالك مع زيزو هو نموذج للاحترافية والاحترام، ولا يصح إلا الصحيح.
– الأمور تسير بصورة قانونية، وبعد انتهاء الشئون القانونية من عملها سترفع تقريراً وتوصية لمجلس الإدارة.
وعلى حد علمنا، لعلها المرة الأولى التى يحرص فيها لاعب أو مدرب على حضور محاميه أثناء التحقيق معه بواسطة ناديه. ولا نُجافى الحقيقة إذا قلنا إنه لم يسبق للفقه القانونى الرياضى أن تناول هذه المسألة بالبحث والتأصيل. ولذلك ارتأيت أنه من المناسب إلقاء الضوء على هذا الموضوع، فى إطار رؤية عامة ونهج عام يرمى إلى وضع بُنيان متكامل للقانون الرياضى من الناحيتين الموضوعية والإجرائية. ولإثراء الموضوع وتحقيق نوع من المشاركة المجتمعية الجادة حول القضايا التى تهم المجتمع، قُمت بمشاركة صورة اللاعب أحمد سيد زيزو برفقة محاميه على صفحتى على موقع «فيس بوك»، طالباً من المهتمين بالقانون الرياضى من الأصدقاء والمتابعين، إبداء رأيهم فى شأن الموضوع. وقد جاءت التعليقات والآراء على النحو التالى:
– من حق المحال اصطحاب محاميه أياً كان موضوع المخالفة. ولا خصوصية للمخالفات الرياضية فى ذلك. ولكن اللاعب أتى من وجهة نظرى مواقف متناقضة ربما تُضعف موقفه، انقطع عن التدريبات وفى الوقت نفسه ينشر صوراً بتدريبه فى الرمال، وبرّر انقطاعه عن التدريب -بخطاب موجه من محاميه- بالإحساس بعدم الأمان عند الذهاب لنادى الزمالك. ثم ينشر صورة سيلفى بصحبة محاميه مبتسمين فى سيارة الجولف داخل النادى. كيف يدير المحامى ملف اللاعب ونزاعه القانونى؟ تضاف إلى ذلك إذا ثبتت لاحقاً مخالفات فى الحصول على التأشيرة، حال رد السفارة الأمريكية، وفى الغالب سترد حال اللجوء للكأس. بلا شك سيكون لها تأثير سلبى على اللاعب (الأستاذ الدكتور عبدالمنعم زمزم، وكيل كلية الحقوق جامعة القاهرة الأسبق وأستاذ القانون الدولى الخاص بالكلية).
– هذا مبدأ أصولى فى المحاكمات، سواء جنائية أو تأديبية (المستشار أيمن عبدالرحمن، نائب رئيس هيئة قضايا الدولة والمستشار القانونى للجنة الأولمبية المصرية سابقاً).
– من حقوق المشكو فى حقه فى الاتهام التأديبى.. حق الدفاع (المستشار الدكتور أحمد خلف، نائب رئيس محكمة الاستئناف والحاصل على الدكتوراه فى القانون الجنائى).
– هذه ضمانة مهمة من ضمانات المحاكمة التأديبية حضور المحامى مع موكله فى التحقيقات (الأستاذة منن محمد ياسر، محامية بالاستئناف العالى).
وبالاطلاع على قانون أو لائحة انضباط الفيفا لسنة 2023، وتحديداً المادة التاسعة والثلاثين منها، والتى وردت تحت عنوان «التمثيل»، نجدها تنص على أنه:
«1 – خلال أى تعامل مع لجنة الأخلاقيات، يجوز للأطراف والأشخاص الآخرين الخاضعين لهذا القانون أن يستعينوا بتمثيل قانونى على نفقتهم الخاصة.
2 – للأطراف والأشخاص الآخرين الخاضعين لهذا القانون الحق فى اختيار ممثليهم بحرية.
3 – يجوز للجنة الأخلاقيات أن تطلب أن يكون ممثلو الأطراف والأشخاص الآخرون الخاضعون لهذا القانون مفوضين بموجب توكيل موقّع حسب الأصول.
4 – يجوز للجنة الأخلاقيات أن تحد من عدد الممثلين القانونيين إذا رأت أن العدد مفرط».
وبالدخول على الموقع الإلكترونى للاتحاد المصرى لكرة القدم، لم نعثر على لائحة الانضباط والأخلاق الصادرة عن الاتحاد المصرى لكرة القدم، بيد أنا وقفنا على نسخة للائحة تعود إلى عام 2019، منشورة بإحدى الصفحات الشخصية على موقع التواصل الاجتماعى «فيس بوك»، ونشير من خلالها إلى المادة ذات الصلة بالموضوع، وهى المادة الرابعة عشرة، التى وردت تحت عنوان «الحضور أمام اللجنة». ووفقاً للبند الأول من هذه المادة، «يجوز لمرتكب المخالفة الاستعانة بمن يراه مناسباً لتمثيله قانونياً أمام اللجنة أو يحضر وكيلاً عنه ما لم تطلب اللجنة حضوره بشخصه، وللجنة توقيع العقوبة المناسبة -فى حالة الضرورة- دون حضوره».
